4. P.Selvagomathi Kumar ... Respondents Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus calling for the final order passed in No. 6208/Law/8/TNSTC/04 dated 28.05.2008 on the file of the 2nd Respondent and further direct the respondent to take severe action against the 4th respondent for the committed guilt by imposing appropriate punishment in accordance with law.
For Petitioner : Mr.K.R.Laxman For Respondents : Mr.N.S.Karthikeyan, Additional Government Pleader.
ORDER
(Order of the Court was made by R.SUDHAKAR,J.) The grievance of the petitioner-Employees Union is that the punishment accorded to the delinquent officers viz., the third and fourth respondents is grossly disproportionate to the magnitude of the crime committed by them. The grievance appears to be justified to some extent but raising the issue for enhancement https://hcservices.ecourts.gov.in/hcservices/
of the punishment by filing public interest litigation would totally inappropriate. Therefore, it is for the Department to pursue the matter if the punishment accorded is grossly disproportionate.
2.The writ petition is dismissed accordingly. No costs. Consequently, M.P(MD)No.1 of 2014 is closed.
