PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the first respondent to consider the aforementioned grounds while disposing the appeal filed by the petitioner in Na.Ka.No.6774 of 2019 pending before the 1st Respondent within stipulated period consequently to restrain the private respondents not to proceed further developments such as alienation construction of Road etc., based on the pattas issued by the 2nd respondent relying the impugned survey effected in Doc.No. 0105/13/097290/2019/13/14/00.0027 SD 25.02.2019 of the 3rd respondent till the disposal of the appeal Na.Ka.No.6774 of 2019. O R D E R

The Writ Petition has been filed in the nature of a Mandamus seeking a direction to the first respondent/Revenue 2/6

Divisional Officer, Dindigul, to dispose of an appeal filed by the petitioner herein in Na.Ka.No.6774/2019, within a reasonable period of time.

2. The said appeal relates to lands in Survey Nos.51/8A1A, 51/8A1B, 51/7B2A, 51/7B2B, 517B3A, 51/7B3B of Manallur Village, Athur Taluk, Dindigul District.

3. The learned Special Government Pleader stated that the first respondent had issued notice for enquiry in Na.Ka.No.6774/2019 M1, to the petitioner and also to the respondents 4 to 6 originally for the hearing date on 05.06.2023 and had next posted it to 16.06.2023.

4. A direction is given to the first respondent to adhere to the principles of natural justice, ensure that all the parties are given proper opportunity to represent themselves and thereafter, endeavour to dispose of the appeal within a period of twelve (12) weeks from the date of appearance of all the parties before the first respondent. 3/6

5. With the above directions, the Writ Petition stands disposed of. No costs.
