ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 147, 188, 294(b), 353, 341 and 506(ii) I.P.C. in Crime No.155 of 2018 seeks anticipatory bail.
2.Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal side) for the respondent. 3.The statue of late.Sri.Posumpon Muthuramalinga Thevar was installed in Kumarakurichi, Sivagangai District some 25 years back. But on account of certain local objection, it was in a covered condition. The accused is said to have removed the cloth, covering the statue. Hence, this case came to be registered. This Court is of the view that custodial interrogation of the petitioner may not be warranted.
4.Taking note of the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Ilaiyankudi and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned https://hcservices.ecourts.gov.in/hcservices/
Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
