Criminal Original Petition Filed Under SC/ST (POA) Act 1989 ,Section 14A(2) of to call for the records relating to the order in Cr.MP.No.1297 of 2024 dated 06.12.2024 in S.C.No.25 of 2022 on the file of the learned Special Court for Trial of Cases under SC/ST (PoA) Act 1989, Thoothukudi and set aside the same. ORDER:- This Criminal Appeal Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s. M.Murugesan, Advocate for the Petitioner and of M/s. A.S. Abul Kalam Azad Government Advocate(Crl .Side), for the respondent(s)1 and 2, this Court made the following order:
This petition is filed to relax the condition imposed on the petitioner, by this Court in Crl.A.(MD)No.8 of 2025, by order dated 14.02.2025.
2. This Court, while granting bail to the petitioner on 14.02.2025 in Crl.A.(MD) No.8 of 2025, directed the petitioner to stay at Madurai and report before the Inspector of Police, Othakkadai Police Station, Madurai, daily at 10.30 a.m. until further orders.
3. The learned counsel appearing for the petitioner submits that the petitioner is regularly complying with the said condition from 25.02.2025 to till date. Therefore, he requests to modify the said condition.
4. The learned Government Advocate (Crl. Side) appearing for the respondent Police objected that the petitioner has not complied with the condition from 25.03.2025 to 05.04.2025 and thereafter, from 07.04.2025 to till date.
5. Since the petitioner has not complied with the condition regularly, this Court is not inclined to allow this petition. Accordingly, this Criminal Miscellaneous Petition is dismissed.
