ORDER
This Court, on 05.03.2026, after hearing the learned counsel for the petitioner, granted an interim stay of the operation of the impugned proceedings.
2. The respondents have filed their counter affidavit.
3. A perusal of the impugned proceedings reveals that the staff fixation under the said impugned proceeding was done by following G.O.Ms.No.231, School Education Department, dated 11.08.2010, and G.O.Ms.No.238, School Education Department, dated 13.11.2018. Insofar as G.O.Ms.No.231 is concerned, the same cannot be made applicable to the petitioner's school, which is a minority school, in the light of the judgment of the Hon'ble Supreme Court in Pramati Educational and Cultural Trust v. Union of India, reported in 2014 (4) MLJ 486 (SC). Insofar G.O.Ms.No.238 is concerned, the operation of the said Government Order has already been stayed by the Division Bench of this Court in W.A(MD)No.1097 of 2023. The petitioner is also stated to be one of the petitioners in the batch of writ petitions challenging the Government Order.
4. Under these circumstances, this Court does not find any reason to vacate the interim order already granted. Unless and until the validity of G.O.Ms.No.238 is decided by the Division Bench, this writ petition cannot be finally disposed of.
5. Hence, the matter shall be listed tentatively after two months.
