O R D E R
This petition is filed seeking a direction to the respondent to complete the investigation and file a final report before the concerned Court within the time stipulated by this Court.
2. The petitioner is the defacto complainant in Crime No.108 of 2015 on the file of the respondent Police, which has been registered for the offence punishable under Sections 294(b), 427 and 506(i) IPC on 16.03.2021. So, the cognizance of the offence has been barred by limitation under Section 468 Cr.P.C. Since the final report is not filed within the time stipulated, the learned Judicial Magistrate No.II, Virudhunagar, by order dated 15.10.2018, recorded that further action is dropped and closed the same in FAD No.197 of 2018 on the same day.
3. It also appears that the respondent Police has not filed any petition before the concerned Court for extension of time and has not taken any steps to challenge the said order.
4. Since the case was closed by the concerned Court, nothing survives for further consideration or for direction in this https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.8737 of 2021 petition. It is open to the petitioner to work out his remedy before the appropriate forum by appropriate proceedings.
5. Accordingly, the Criminal Original Petition is disposed of.
