ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent police in connection with the case in Crime No.96 of 2024 for the offence under Section 379 I.P.C., has filed this petition, seeking anticipatory bail. 1/3
2. The case of the prosecution is that the petitioner and other accused have illegally transported 7 bags of river sand.
3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.
4. The learned Government Advocate (Crl. Side) appearing for the respondent submits that there are four accused in this case, the petitioner is arrayed as A3. The investigation is yet to be completed. He further submits that the petitioner is having three previous cases, similar in nature.
5. Considering the nature of offence and considering the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
