For Respondent : Mr.M.MUTHUMANIKKAM, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.168 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioners/Accused No.3 to 6 apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 294(b), 323 and 506(ii) of IPC on the file of the respondent police in Crime No.168 of 2022, seek anticipatory bail.

2.The case of the prosecution is that due to previous enmity between the parties, the petitioners and other accused abused the de-facto complainant in filthy language and attacked him with hands and also caused him injuries. Hence the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl.Side) would submit that the petitioners attacked the de-facto complainant and caused him injuries. He would further submit that the injured was discharged https://hcservices.ecourts.gov.in/hcservices/ 1/2

No.9713 of 2022 from the hospital and the case in counter is pending against the defacto complainant. 5.Considering the nature of allegation levelled against the petitioners and considering the facts that the injured was discharged from the hospital and that the counter case is pending against the de-facto complainant, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. 6.Accordingly, petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.IV, Tirunelveli, and on their executing a bond for a sum of Rs.

10,000/- (Rupees Ten thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.30 am., for a period of one month and thereafter, as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously. 7.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
