O R D E R

The prayer sought for in this writ petition is for a Writ of Mandamus, directing the 2nd respondent herein to dispose of the revision petition dated 10.02.2018 filed by the petitioner within a reasonable time as may be fixed by this Court in accordance with law and on merit.

2.Heard Mr.C.Padmaraj, learned counsel appearing for the petitioner and Mr.K.Saravanan, learned Government Advocate appearing for the respondents.

3.The learned counsel appearing for the petitioner would submit that the petitioner is the Secretary of the Co-operative Society against whom, Section 81 of Tamil Nadu Co-operative Societies Act, enquiry was conducted and final order was passed, as against which, under Section 153 of the said Act, a revision was filed before the second respondent, who is the revisional authority, on 10.02.2018. Though the revision was filed on 10.02.2018, the same was not taken up for consideration. Therefore, the petitioner had given representation to the first respondent sometime in April 2018 and https://hcservices.ecourts.gov.in/hcservices/

the first respondent also, by letter dated 19.04.2018, communicated the petitioner that the request of the petitioner has been forwarded to the second respondent for appropriate consideration. In spite of these developments, the second respondent, so far has not considered the revision and it is kept pending. Therefore, if the said revision petition filed by the petitioner is directed to be disposed of, the petitioner would be satisfied.

4.I have heard the learned Government Advocate appearing for the respondents, who would submit that the said revision petition filed by the petitioner dated 10.02.2018 would be decided on merits and in accordance with law by the second respondent, within a period of three months.

5.Considering the said submissions made by both sides, this Court is inclined to pass the following order: "The second respondent is directed to decide the revision petition dated 10.02.2018 filed by the petitioner, on merits and in accordance with law and final order shall be passed, within a period of three months from the date of receipt of a copy of this order."

6.With the above direction, this writ petition is disposed of. No costs.
