ORDER
The prayer sought for in this writ petition is for a Writ of Mandamus, directing the 3rd respondent to immediately send the proposal and recommendation to the 1st respondent on the petitioner's application for compassionate appointment and consequently direct
the 1st respondent to grant him appointment on compassionate ground by considering the petitioner's representation dated 11.06.2018. 2.Heard Mr.B.Rooban, learned counsel appearing for the petitioner and Mr.D.Muruganantham, learned Additional Government Pleader appearing for the respondents.
3.The petitioner's father one C.Tamilarasan was working as Salesman at the third respondent Society from 1985. Though he served for several years, on 25.04.2016, he died suddenly due to heart attack, while he was in service. Because of the sudden death of the father of the petitioner, who was the only breadwinner of the family, the family of the petitioner with his mother and sister has been struggling a lot to meet both the ends. Therefore, the petitioner made a request by way of application to the third respondent to consider his candidature for appointment at the third respondent Society on compassionate ground. Even though the said application was made as early as on 22.07.2016 and a copy of the same also had been given to other respondents and in this regard, on 01.12.
2016, the first respondent had directed the second respondent to forward the necessary proposals along with the documents of the petitioner's request for consideration on compassionate appointment, even thereafter, nothing was moved and still the third respondent Society kept the said application filed by the petitioner pending without forwarding the same to the first respondent for consideration of compassionate appointment.
4.In this regard, the learned counsel appearing for the petitioner would submit that if a direction is given to the respondents to consider the said request of the petitioner dated 22.07.2016 for the purpose of compassionate appointment and an order to that effect would be directed to be passed, within a time frame, the petitioner would be satisfied.
5.I have heard the learned Additional Government Pleader appearing for the respondents, who would submit that the said request of the petitioner dated 22.07.2016 would be considered by the respondents on merits and in accordance with law, within a time frame.
6.Considering the said submissions made by both sides and taking into account the limited scope of the writ petition, this Court is inclined to pass the following order: "The respondents are directed to consider the application made by the petitioner dated 22.07.2018, seeking compassionate appointment at the third respondent Society and pass orders, thereon, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order."
7.With the above direction, this writ petition is disposed of. No costs.
