For Respondent : Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.311 of 2022 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/Accused (Rank Not Known), apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 380 of I.P.C, in Crime No.311 of 2022 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 16.05.2022, at about 07.45 p.m, the defacto complainant has lodged a complaint stating that the defacto complainant is working as accountant in Sacs Power (P) Ltd., and the CCTV Cameras, which are fixed in front his Company was taken away by the some unidentifiable persons and also CCTV Cameras fixed in nearby Companies.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case.

4.The learned Government Advocate (Crl. Side) for the respondent police submitted that the second accused was arrested and from him 1 CCTV Camera was recovered and this petitioner is absconding. Based upon the confession statement given by the co-accused, the petitioner was arrayed as an accused and he has 4 previous cases.

CRL OP(MD). No.9771 of 2022 5.Since it is a case of theft causing damage to CCTV Cameras, granting anticipatory bail will damage the investigation process. The petitioner may surrender before the respondent police. It is seen that the petitioner is involved in 4 previous cases. Out of which, one 397 IPC case is also pending against him. Hence, the petitioner is not entitled for discretionary relief of anticipatory bail.
