For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No. 205/2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 9 (B)(1)(a) of Indian Explosives Act, 1884, in Crime No.205 of 2022, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner along with other persons were manufacturing the fire crackers without the approval of the government and the respondent police seized 30 kgs of Skyshot crackers, 3 Kgs of aluminium powder, 25 kgs of Karithusi, 25 kgs of Yellow Kaavi power. Hence, the complaint. 3.The learned Counsel for the petitioner submits that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution, but, a false case has been foisted as against him. He further submitted that the co-accused were arrested and thereafter released on bail.

CRL OP(MD). No.9752 of 2022 4.The Learned Government Advocate(Crl.Side)appearing for the respondent police submitted the accused Nos. 1 and 2 are the employees of this petitioner and they were arrested and thereafter released on bail and the petitioner is the owner of the property.
5. Taking into consideration the allegations and gravity of the offence committed by this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. The petitioner shall surrender before the respondent police and thereafter, seeks regular bail.
