ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent Police for the offences under Sections 147, 148, 341, 294(b), 307 and 506 (ii) I.P.C and section 3 of Explosive Substances Act, 1908 and Section 3 of TNPPDL Act in Crime No.132 of 2018 and seeks anticipatory bail.
2.Heard the learned counsel appearing for the petitioners as well as the learned Government Advocate (Crl. side) appearing for the respondent and the learned counsel appearing for the intervener. 3.The learned counsel appearing for the intervener strongly objected the grant of any relief to the petitioners herein. 4.The first petitioner is having a number of cases to his credit. Therefore, this Criminal Original Petition is dismissed in sofar as the first petitioner is concerned. The second and third petitioners are not having previous cases to their credit and also they have been falsely implicated in this case only on the strength of confession. Taking note of the fact that the petitioners 2 and 3 are not having any previous case, this Court is inclined to grant anticipatory bail to the petitioners 2 and 3 alone with certain conditions. Accordingly, the petitioners 2 and 3 are ordered to be https://hcservices.ecourts.gov.in/hcservices/
released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Srivaikundam and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners 2 and 3 shall appear before the respondent police for a period of seven days daily at 10.30 a.m from the date of receipt of a copy of this order and thereafter as and when required for interrogation. The petitioners 2 and 3 shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 5.The petitioners 2 and 3 shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
