Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 22 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner, who is arrayed as A2, apprehending arrest at the hands of the respondent police for the offence punishable under sections 366A and 417 of IPC, in Crime No.22 of 2020 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner and A1 said to have kidnapped the minor girl, who is aged about 17 years, for the purpose of getting marriage. Hence, a complaint has been registered.

3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent.

CRL OP(MD). No.9373 of 2020 4.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the only allegation against the petitioner is that he has provided car to A1. Hence, he prayed for grant of anticipatory bail to the petitioner. 5.The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that this is the second application. He further submitted that the victim girl yet to be secured. 6.This is the second application and there is no change of circumstances to entertain this application. Considering the above facts and circumstances of the case and also considering the submission made by the Government Advocate (Crl. Side) that the victim girl yet to be secured, I am not inclined to grant anticipatory bail to the petitioner.

7.Accordingly, this Criminal Original Petition stands dismissed.
