COMMON PRAYER :-For Bail in Crime No.414 of 2022 on the file of the respondent police.
COMMON ORDER : The Court made the following order :- The petitioners/A3, A2, A4 and A5, who were arrested and remanded to judicial custody on 15.04.2022 for the offences punishable under Sections 4(1)(aaa), 4(1-A), 5 and 6 of Tamil Nadu Prohibition Act r/w Sections 420, 465, 468 and 471 of IPC, in Crime No.414 of 2022, on the file of the respondent police, seek bail. 2.The case of the prosecution is that the petitioners and others manufactured duplicate liquor bottles and liquor. https://hcservices.ecourts.gov.in/hcservices/ 1/2
3.On the side of the petitioners it is stated that the petitioners and others were working under the first accused. They are labours. Property recovered only from the first accused and not from these petitioners. The petitioners are in judicial custody for the past 45 days, hence, he seeks bail.
4.On the side of the respondent it is stated that the petitioners are workers under the first accused. The first accused is the owner. The accused involved in the manufacturing of duplicate liquor bottles and liquor. There is no previous cases against the petitioners.
5.Considering the facts and circumstances of the case and also considering the nature of the offence and the overt act against the petitioners and also the period of incarceration, this Court is inclined to grant bail to the petitioners. Accordingly, these Criminal Original Petitions are allowed and the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.4, Trichy and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. for a period of thirty (30) days and thereafter, as and when required for interrogation.
