PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, restraining the second respondent from entertaining/registering the document presented by the respondents 3 to 9 in respect of the property comprised in Old Survey No.78/2, New Survey No. 78/2A1 and 78/2A2, situated in Door No.49, Maniyakarar Street, Ward No. 16, Thiruppuvanam Puthur, Thiruppuvanam Post and Taluk, Sivagangai District, within a stipulated time period in accordance with law on the basis of the objection/representation 11.12.2025 and 25.03.2026. ORDER

The present writ petition has been filed seeking a Writ of Mandamus restraining the second respondent from entertaining or registering the documents presented by the respondents 3 to 9 in respect of the property comprised in Old Survey No.78/2, New Survey Nos.78/2A1 and 78/2A2, situated at Door No.49, Maniyakarar Street, Ward No.16, Thiruppuvanam Puthur, Thiruppuvanam Post and Taluk, Sivagangai District, by considering the petitioner's representations dated 11.12.2025 and 25.03.2026.

Upon perusal of the representations and other documents on record, it is seen that the petitioner has submitted objections to the registration of the documents in respect of the abovesaid survey numbers, contending that third parties are attempting to register the property by taking advantage of a mistake committed during the UDR settlement.

3. I have heard the learned counsel for the petitioner and the learned Special Government Pleader appearing on behalf of the respondents 1 and 2.

4. It is clarified that merely because the petitioner has submitted a representation, the relief sought to prevent the Sub-Registrar from accepting the documents cannot be granted. However, since the objection is on record, as and when any document in respect of the aforesaid survey numbers is presented for registration, the Sub-Registrar shall issue notice to the petitioner as well as to the executants, claimants, or any other person interested, conduct an enquiry, consider the objections, and pass appropraite orders in accordance with law.
