ORDER

The present petition has been filed seeking police protection to the petitioner to run his shop.

According to the learned Counsel appearing for the petitioner, the shop is owned by one Saraswathi, who had filed O.S.No.529 of 2023, before the II Additional Sub Court, Nagercoil, and got an order of eviction on 04.02.2025. The petitioner who is a tenant had already filed A.S.No.39 of 2025, before the Principal District Court, Kanyakumari, and the same is pending. In the meantime, the landlord has also filed execution proceedings in E.P.No.19 of 2026, and the same is also pending.

3. In such circumstances, the son of the landlord is said to have entered into the premises and damaged the properties and threatening the petitioner not to run the shop. The petitioner has lodged a police complaint and an FIR has 2/5

been registered in crime No.94 of 2026 on 07.03.2026 on the file of the 5th respondent police.

4. In the light of the above said facts, now the petitioner seeks police protection to run the shop. It is for the petitioner to place these materials before the concerned appellate Court seeking interim orders. The police cannot be stationed permanently in front of the shop of the petitioner. In case of any subsequent incident of threatening or preventing the petitioner from opening of the shop, it is open to him to approach the jurisdictional police.

5. With the above said observations, this Criminal Original Petition stands disposed of.
