ORDER
(Order of the Court was made by N.ANAND VENKATESH,J.) This Habeas Corpus Petition has been filed for a direction to respondents 1 and 2 to produce the body or person of the petitioner's son and set him at liberty.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondents.
3. The case of the petitioner is that his second son, aged about 26 years, went missing from 15.07.2025. Since his whereabouts could not be ascertained, a complaint was given before the second respondent, based on which a man-missing FIR was registered in Crime No.384 of 2025. Since no effective steps were taken to find the whereabouts of the petitioner's son, the present petition has been filed before this Court.
4. The learned Additional Public Prosecutor, on instructions, submitted that the boy had an intimacy with a lady and in the course of investigation, the Investigation Officer was able to trace the whereabouts of the boy at Bangalore and steps are being taken to secure him and proceed further in accordance with law.
5. Considering the facts and circumstances of this case and the submissions made on either side, there shall be a direction to the second respondent to produce the detenue before the Judicial Magistrate, Alangulam and the learned Judicial Magistrate shall record the statement of the detenue and proceed further in accordance with law. On the date of producing the detenue before the learned Magistrate, the petitioner shall be put on notice.
6. This Habeas Corpus Petition is disposed of with the above terms. No costs.
