PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for the records pertaining to the charge sheet in Spl.S.C.No.156/2025, on the file of the Special Court of Exclusive Trial of Cases under POCSO Act Cases, Dindigul in Crime No.16 of 2025, on the file of the Respondent No.1 and quash the same as illegal.

ORDER

The present petition has been filed by the sole accused in Spl.S.C.No.156 of 2025, on the file of the Special Court of Exclusive Trial of Cases under POCSO Act Cases, Dindigul, seeking to quash the charge sheet wherein the petitioner is charged with the offences under Sections 5(j)(ii), 332(b), 5(l), 6 of POCSO Act and Section 87 of the BNS Act, 2023.

2. The date of birth of the victim girl is 13.02.2008, and she attained majority on 13.02.2026. After attaining majority, she married the sole accused on 18.06.2026. The marriage was registered under the Christian Marriage Act, 1872 before the Thiranthavasal Church, VOC Nagar, Thuvakudimalai, Trichy.

3. Pending trial, the parties have entered into a compromise wherein the defacto complainant had agreed for quashing of the charge sheet.

4. The victim girl had appeared before this Court on 07.04.2026 and the matter was adjourned to today for the production of the marriage certificate. Today, the marriage certificate has been produced. The defacto complainant is present in-person and she acknowledges the fact that she had agreed for quashing of the charge sheet.

5. Considering the above said facts, charge sheet in Spl.S.C.No.156 of 2025, on the file of the Special Court for Exclusive Trial of Cases under POCSO Act Cases, Dindigul, is hereby quashed.
