Crime No.4/2018 Complainant PRAYER: Criminal Original Petition filed under Section 439(i)(b) of the Criminal Procedure Code, to modify the order passed by the learned Principal District Sessions Judge, Trichirappalli in Cr.M.P.No.1230 of 2018, dated 15.03.2018.

O R D E R

This petition has been filed to modify the order passed by the learned Principal District Sessions Judge, Trichirappalli in Cr.M.P.No.1230 of 2018, dated 15.03.2018.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent. 3.The petitioner was granted anticipatory bail by the learned Sessions Judge on condition that he should pay a sum of Rs.3,37,500/-. The learned counsel for the petitioner submits that the petitioner is a daily wages employee and that therefore he is not in a position to mobilize the funds immediately. He undertook to deposit the said amount in five equal monthly installments. The first installment shall be paid on or before 20.08.2018. Even, if there is any default in paying one installment, this order would stand cancelled, automatically.

4.The learned counsel for the petitioner, on instruction of the petitioner, undertakes that he will not apply for any modification or relaxation of this condition. Granting the facility of paying the amount in question in five equal monthly https://hcservices.ecourts.gov.in/hcservices/

installments, the order dated 15.03.2018 passed by the learned Principal District and Sessions Judge, Trichirappalli stands modified. Accordingly, this Criminal Original Petition is allowed. Consequently, the connected miscellaneous petition is closed. 5.The learned counsel for the petitioner seeks extension of time for surrender and execute the sureties. His request is accepted. The time for surrender and execute the sureties is extended by two weeks from the date of receipt of a copy of this order.
