ORDER
This Writ Petition has been filed seeking for the issuance of Writ of Mandamus, directing the respondents 1 to 3 to grant permission and necessary protection to conduct the festival and cultural programme at Arulmighu Mariamman, Kaliamman, Bagavathiamman, Karpagavinayagar, Murugan Koil, Thiru Vizha at Perumampatti, Pannapatti Melpakam Village, Manaparai Taluk, Trichy District on 03.05.2015 and 04.05.2015.
2. Heard the learned counsel appearing for the petitioner, the learned Additional Government Pleader appearing for the respondents 1 to 3 and the learned Counsel for the fourth respondent. https://hcservices.ecourts.gov.in/hcservices/
3. The learned Counsel for the petitioner submitted that the respondent No.4 is objecting the proposed function and while there is no objection for the fourth respondent for conducting the function on 17.05.2015 and 18.05.2015, the petitioner cannot be objected to conduct the function on 03.05.2015 and 04.05.2015.
4. The learned Counsel for the fourth respondent submitted that the respondent No.4 is the village headman and there is a suit filed by the petitioner claiming the said right in O.S.No.361 of 2014, on the file of the District Munsif Court, Manaparai.
5. Considering the rival submissions, this Court directed the petitioner to appear before the second respondent and purforth his case. It is open to the second respondent to call for the respondent No.4. It is also open to the second respondent to refer the matter to the Tahsildar concerned for conducting a peace committee meeting. The entire exercise will have to be done on or before 02.05.2015.
6. Accordingly, the Writ Petition is disposed of with the above directions. No costs.
