ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offence punishable under Section 420 of I.P.C., in Crime No.not known of 2018, on the file of the respondent police, seeks anticipatory bail.
2. The learned counsel for the petitioner submitted that Nagendran is now attacked by paralytic stroke and an undertaking has been filed that the sum of Rs.3,50,000/- would be returned to the defacto complainant within a period of 90 days. It appears that there is a dispute regarding quantum.
3. In view of the undertaking given by the petitioner in Crl.O.P.(MD)No.6968 of 2018 to return a sum of Rs.3,50,000/- to the defacto complainant, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Theni, and executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. 4. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
