O R D E R

The only ground on which the petitioner has filed the present writ petition is that though he had scored 74.625% in his higher secondary course and the cut-off marks for B.C.A.LL.B.(Hons) Course was fixed at 74.250%, he has not been called for counselling. https://hcservices.ecourts.gov.in/hcservices/

2. In view of the above submission, this Court by order, dated 20.07.2018, permitted the petitioner to participate in the counselling scheduled to be held on 21.07.2018 and directed the Registry to list the matter today (i.e.02.08.2018).

Today, when the matter was taken up for hearing, the learned standing counsel for the respondents submitted that in obedience to the orders of this Court, dated 20.07.2018, the petitioner was permitted to participate in the counselling. Nevertheless, it is his specific submission that the petitioner herein had not made any application to the University seeking for admission. In normal course, without any application, the candidature of the applicants need not be considered. As such, I do not find any infirmity on the part of the respondent - University in not calling the petitioner for the counselling in the first instance.

4. However, the fact remains that the petitioner had remitted a sum of Rs.1,000/- for the purpose of seeking admission to B.C.A.LL.B (Hons) Course, before the respondents herein. The learned counsel for the petitioner further submitted that it is by an inadvertence that the petitioner had not submitted application and since the petitioner has secured over and above the cut-off marks prescribed for the said Course. As such, sympathetic view may be taken in his case, in the interest of the candidate's future career.

5. In the light of the above observations, there shall be a direction to the respondents herein to consider the petitioner's candidature in accordance with their norms and in the light of the counselling held for him on 20.07.2018.

6. With the above directions, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
