Respondents PRAYER:- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a WRIT OF MANDAMUS, directing the 1st Respondent to dispose of the Petitioners statutory appeal dated 28.06.2023 filed against the order of dismissal from service dated 08.05.2023 passed by the second Respondent, within a time frame as may be fixed by this Court.

Heard the learned counsel for the petitioner and the learned Standing Counsel for all the respondents.

2. By consent of both the parties, this writ petition is disposed of at the admission stage.

The short ground raised by the petitioner in this writ petition is that the second respondent has imposed a punishment of dismissal from service vide order dated 08.05.2023 and aggrieved by the same, the petitioner claims to have filed a statutory appeal before the first respondent under Regulation 17 of Central Bank of India Officer Employees' (Discipline and Appeal) Regulation, 1976, as early as on 28.06.2023. But the said appeal is still pending and no action has been taken by the first respondent. Hence, the petitioner approached this Court by filing the present writ petition seeking for expeditious disposal of the said appeal dated 28.06.2023.

4. Mr. N.Dilip Kumar, learned Standing Counsel appearing for the respondents fairly submitted that the appeal filed by the petitioner would be considered and disposed of within a period of eight weeks from today.

5. In the light of the above, without going into the merits of the matter, this writ petition is disposed of at the admissions stage directing the first respondent to dispose of the appeal dated 28.06.2023 filed by the petitioner against the proceedings bearing No. Zo/DEL/HCM/DAD/2023-2123 dated18.05.2023 as expeditiously as 3/6

possible, at any rate, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
