PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 3 to provide adequate police protection for conducting the Temple Car festival scheduled to be held from 03.06.2022 to 09.06.2022 in Sri Selvamariamman and Sri Muthumariamman Temple situated at Sengattupatti Village (Devendrakula Velalar Street), Thuraiyur Taluk, Tiruchirappalli District.

O R D E R

This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus directing the respondents 1 to 3 to grant permission to conduct Car festival programme from 03.06.2022 to 09.06.2022 in Sri Selvamariamman and Sri Muthumariamman Temple at Sengattupatti Village (Devendrakula Velalar Street), Thuraiyur Taluk, Tiruchirappalli District and to give necessary police protection to the said programme.

2.Mr.R.Sureshkumar, learned Government Advocate (Criminal Side) takes notice for the respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3.The learned counsel appearing for the petitioner submitted that the petitioner gave a representation to the respondent police seeking permission and protection to conduct the Car Festival from 03.06.2022 to 09.06.2022 in Sri Selvamariamman and Sri Muthumariamman Temple at Sengattupatti Village (Devendrakula Velalar Street), Thuraiyur Taluk, Tiruchirappalli. Though he gave a representation on 23.05.2022, no permission has been given till date. Hence, the present writ petition.

4.The learned Government Advocate (criminal side) appearing for the respondent police would submit that the respondents have received the representation of the petitioner and the same is pending for consideration. He further submitted that the said programme has not been done for several years. In respect of the same, a peace committee has been conducted.

5.Mr.Saravanakumar, learned counsel appearing for the intervenor submitted that the intervenor is the one of the members of the peace committee and he has no objection to conduct the Car Festival in the said temple.

6. I have considered the submission of the learned counsel appearing for the petitioner, learned Government Advocate (criminal side) appearing for the respondent police and the learned counsel appearing for the intervenor.

7. Considering the facts and the circumstances of this case and also considering the submission of both the learned counsels, this Court directs the third respondent police to give permission and necessary police protection for conducting the Car Festival programme from 03.06.2022 to 09.06.2022 in Sri Selvamariamman and Sri Muthumariamman Temple at Sengattupatti Village (Devendrakula Velalar Street), Thuraiyur Taluk, Tiruchirappalli, in a peaceful manner.

8.With the above direction, this writ petition is disposed of. No cost.
