This writ petition has been filed seeking a direction to survey the petitioner's land in Survey No.799 in Kottanatham Village with the help of police protection.
2. According to the petitioner, he is the owner of the property in Survey No.799 in Kottanatham Village and he want to measure the property in question. Therefore, he has submitted a representation before the concerned authority. When the authority attempted to measure the land, the respondents 4 to 6 prevented the authority from measuring the land and hence, the petitioner has filed this Writ Petition.
3. I have heard the learned counsel for the petitioner, the learned Additional Government Pleader appearing for the respondents 1 to 3 and also the learned Counsel appearing for the respondents 4 to 6.
4. Since the petitioner only wants to measure and survey his land, if at all the respondents 4 to 6 are having any objections to survey the land, it is open to the respondents 4 to 6 to file objections, if any, before the second respondent/concerned Tahsildar within a period of two weeks from the date of receipt of a copy of this order. If any such objections is filed, the Tahsildar concerned shall consider the same and pass orders, on merits and in accordance with law, after affording due opportunity of hearing to the petitioner and respondents 4 to 6, within a period of six weeks thereafter.
5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
