PRAYER :- For Bail in Crime No.181 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 19.05.2022 for the offences punishable under Sections 4(1)(a) and 4(1-A) of TN Prohibition Act in Crime No.181 of 2022, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner is said to have illegally possessed 10 bottles of 180ml SEAMENS Brandy and hence, the above complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would also submit that the petitioner is in judicial custody from 19.04.2022, hence, he seeks bail. 4.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner is having four previous cases and hence, he opposes this application. 5.Considering the facts and circumstances of the case and also taking into consideration the period of incarceration, this Court is inclined to grant bail to the petitioner. CRL OP(MD). No.9817 of 2022 released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Thanjavur District and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
