Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to issue patta to the petitioner's house property to an extent of 1242 sq.feet in Survey No.338/10, Somanathamangalam Group, Kalayarkovil Taluk, Sivagangai District, on the basis of the petitioner's representation, dated 15.04.2021. O R D E R

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the second respondent to consider the representation made by the petitioner on 15.04.2021, wherein, the petitioner is seeking for issuance of patta in her name.

2. The case of the petitioner is that the subject property was purchased by her husband through a registered sale deed, dated 18.01.2006. The further case of the petitioner is that an application was made before the second respondent seeking for issuance of patta and at that point of time, the petitioner came to know that the property has been classified as "Sarkar Kalimanai".

3. According to the petitioner, similarly placed persons had already made a representation and had been issued patta. Therefore, the petitioner also made a representation on 15.04.2021 before the second respondent. Since the same was not considered, the present Writ Petition has been filed before this Court seeking for appropriate directions.

4. Heard Mr.D.Senthil, learned counsel appearing for the petitioner and Mr.R.Suresh Kumar, learned Government Advocate appearing on behalf of the respondents.

5. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the second respondent to consider the representation made by the petitioner on 15.04.2021 and deal with the same on its own merits and in accordance with law and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order.

6. The petitioner is directed to make a fresh representation to the second respondent along with all the relevant documents and also a copy of this order.

7. This Writ Petition stands disposed of with the above directions. No costs.
