PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.246 of 2022 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 408 IPC, in Crime No.246 of 2022, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the defacto complainant, who is working as Secretary in-charge of the Madura Coats Employees Co-operative Society, has lodged a complaint before the respondent police stating that the said society runs a pharmacy in the name and style of Amma Marundhagam, in which, the petitioner was working as Pharmacist from the year 2014 and on 10.03.2022, the petitioner submitted his resignation, but the defacto complainant refused to accept the same and during audit, it was found that the petitioner had misappropriated a sum of Rs.8,51,474/-. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.

CRL OP(MD). No.9850 of 2022 4.The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that investigation is in earlier stage.
5.Considering the nature of charges levelled against the petitioner and also the quantum of amount involved and also the fact that the investigation is in earlier stage, this Court is not inclined to grant anticipatory bail to the petitioner. 6.In the result, this Criminal Original Petition is dismissed. sd/- 17/06/2022 / TRUE COPY / 22/06/2022 Sub-Assistant Registrar (C.S.)
