When the matter was taken up for hearing, the learned Government Advocate (Crl.side) submits that the petitioner was summoned only for enquiry. As of now, he has not been fixed as an accused. Therefore, the respondent shall issue notice under Section 41 A of Cr.PC if the petitioner is later fixed as an accused.
