ORDER

This petition has been filed to call for the records relating to the impugned order in Crl.M.P.No.607 of 2024 dated 18.03.204 passed by the learned Principal 1/4

Special Court for EC & NDPS Act Cases, Madurai and set aside the same.

2. The petitioner is the accused in Crime No.455 of 2023 and the petitioner was arrested on 07.09.2023. Even after expiry of 180 days, the final report was not been filed before the concerned Court and on that ground, the petitioner filed petition under Section 167(ii) of Cr.P.C seeking statutory bail and the same was dismissed stating that the final report was filed in time.

3. The learned counsel for the petitioner submitted that after filing the statutory bail petition only, the respondent police filed the final report before the concerned Court.

4. Considering the submission made by the learned counsel for the petitioner, this Court directed the Registry to call for the report from the concerned Court below with regard to the date of filing the final report.

5. Perusal of report shows that the final report was filed on 03.03.2024. Therefore, submission of the learned counsel for the petitioner is not correct and he also submitted that on that date, incomplete final report was filed. 2/4

6. Perusal of report shows that while filing the final report the concerned officer filed all the materials along with the final report before the Court and the same was returned directing to upload all seizure documents separately and the same was duly complied with by the concerned officer on 05.03.2024.

7. Before filing the statutory bail petition, the respondent police filed the final report before the concerned Court. Therefore, this Court does not find any merits in this case. Accordingly, this Criminal Revision Case is dismissed. 07.06.2024 Index : Yes / No Internet : Yes / No tta To,
