2.Heard the learned counsel appearing for the petitioners and the learned counsel appearing for the first respondent/Sole Accused. 3.It is submitted by the learned counsel appearing for the first respondent that the entire amount has been settled to the petitioners 2 and 3.

4. As far as the first petitioner is concerned, the first respondent submitted that the first petitioner is entitled to Rs.5,00,000/- as per the statement of accounts. Further first petitioner has borrowed Rs.2,48,000/- and he has to repay the same. Hence the first respondent submitted he is ready to pay the balance amount of Rs.3,10,000/- to the first petitioner.

5. Accepting the said contention, the first respondent is directed to pay Rs.3,10,000/- to the petitioner. As far as the balance amount of Rs.2,48,000/- is concerned, the first petitioner is at liberty to approach the appropriate Civil Court / arbitration, whichever is available. Also the first respondent is is at liberty to approach the appropriate Civil Court / arbitration, whichever is available
