Respondents Prayer: This Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to consider the representation of the petitioner, dated 01.04.2021 and dispose of the enquiry proceedings in Na.Ka.No.A3/2550/2018 and cancel the free house site Patta stands in the name of 3rd respondent and to issue fresh patta in the name of the family members of the petitioner.

ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the first respondent to consider the representation made by the petitioner on 01.04.2021 and to dispose of the proceedings in Na.Ka.No.A3/2550/2018 within the time frame fixed by this Court.

2. The case of the petitioner is that the subject property was assigned in favour of the third respondent in the year 2005 under the Free Housing Plot Scheme for landless poor. According to the petitioner, this property belongs to private individuals and the petitioner is their legal heir.

3. The petitioner therefore made a representation / complaint to the respondents on 21.04.2018. According to the petitioner, the first respondent conducted an enquiry during February 2020 and thereafter, there was no progress. Left with no other option, the present Writ Petition has been filed before this Court seeking for appropriate directions.

4. Heard Mr.M.Karthikeyavenkitachalapathy, learned counsel appearing for the petitioner and Mr.M.Lingadurai, learned Government Advocate appearing for the respondents.

5. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the first respondent to dispose of the proceedings pending in Na.Ka.No.A3/2550/2018 after affording opportunity to the petitioner and the third respondent and deal with the same on its own merits and in accordance with law and pass final orders within a period of six (6) weeks from the date of receipt of a copy of this order.

6. The petitioner is directed to make a fresh representation to the first respondent along with all the relevant documents and also a copy of this order.

7. The Writ Petition stands disposed of with the above directions. No costs.
