ORDER : The Court Made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 342, 294(b), 324 and 506(ii) I.P.C, in Crime No.193 of 2013, seek anticipatory bail.
2.Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Criminal side) appearing for the respondent.
3.The petitioners are shown as accused in Crime No.193 of 2013. The final report has been filed and the same was taken on file as C.C.No.361 of 2017 on the file of the learned Judicial Magistrate, Nilakottai. Since absconding charge sheet was filed, NBW has been issued.
4.The learned counsel for the petitioners submits that the petitioners are all belonging to Arunthathiyar community and they were poor.
5.In view of the same, the petitioners are permitted to surrender before the learned Judicial Magistrate, Nilakottai on next hearing date and to file a recall warrant petition. The concerned Jurisdictional Magistrate is directed to recall the warrant on the same day.
6.Since the petitioners are 40 in numbers, they are permitted to furnish two common sureties.
