ORDER

This criminal original petition has been filed to call for the records in C.C.No.79 of 2018, on the file of learned Judicial Magistrate No.II, Karur, Karur District and to quash the same.

2. After elaborately hearing the learned Counsel on either side, this Court is about to dismiss this criminal original petition on merits. At this juncture, the learned Counsel for the petitioner submitted that it would suffice if an order dispensing with the personal appearance of the petitioner before the Court below is passed by this Court.

3. The learned Government Advocate (Crl. Side) has no serious objections in dispensing with the personal appearance of the petitioner before the Court below, since the petitioner, is a senior citizen, aged about 76 years.

4. In view of the submission made by the learned Counsel on either side, this Court, without expressing any opinion on the merits of the matter, is inclined to pass the following order: https://hcservices.ecourts.gov.in/hcservices/ ● the personal appearance of the petitioner before the learned Judicial Magistrate No.II, Karur, Karur District, in C.C.No.79

of 2018, is dispensed with. However, the petitioner shall appear before the Court below, as and when, the Court insist upon his appearance.

5. With the above directions, this criminal original petition is disposed of. Consequently, connected miscellaneous petitions are closed.
