Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the Respondents to grant permission and necessary police protection to perform the festival from 03.06.2022 to 06.06.2022 by conducting various programmes namely Sri Valli Thirumanam Nadakam on 03.06.2022, Sri Mahamayee Nadagam on 04.06.2022, Arichandra Mayana Kandam on 05.06.2022 and cultural programmes Adalum Padalum on 06.06.2022 in the eve of Mudalaikulam Arulmighu Sri Kamba Kamatchiamman, Sri Karuppaswamy Kovil Urchava Thiruvizha at Mudalaikulam Village, Usilampatti Taluk, Madurai District by considering the representation of the petitioner dated 10.04.2022. J U D G M E N T
(Judgment of the Court was delivered by G.JAYACHANDRAN, J.) Heard the learned counsel for the appellant and the learned Special Government Pleader for the respondents. 2.The appellant herein has approached this Court seeking permission to conduct Drama, Music and Dance Programme in connection with the Temple festival.
3.The learned Single Judge while allowing the Writ Petition has restricted the time for conducting the above events between 08.00 a.m and 11.00 p.m.
4.The grievance of the appellant is that as far as the Drama programmes fixed on 03rd, 04th and 05th of June, 2022, conventionally to be held during the night starting from 10.00 p.m to 05.00 a.m in the next day morning.
5.Since the time restriction imposed by the learned Single Judge will counteract the conduct of the programme, considering the submissions made by the learned counsel for the appellant, the order of the learned Single Judge, dated 05.05.2022, is modified to the effect that the time restriction imposed in Paragraph No.5, Clause (c), shall be applicable only for the cultural event of "Adal Padal" scheduled to be held on 06.06.2022 and insofar as the "Drama Programmes" scheduled to be held on 03rd, 04th and 05th of June, 2022, it shall be between 10.00 p.m on that day and 05.00 a.m in the next day morning.
6.With the above modification, the Writ Appeal is disposed of. No costs.
