PETITION FOR BAIL Under Sec.439 of Cr.P.C.

PRAYER :- For Bail in Crime No.75 of 2021 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 18.01.2021 for the offences punishable under Sections 8 (c), r/w 20(b)(ii)(c), 25, 29(1) of NDPS Act in Crime No.75 of 2021 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that A1 and A2 had procured 500 kgs of ganja from A16 and the same had been transported in Mahindra TUV 300 car bearing Reg.No.TN 65 AF 5297 by A3 and A4, who in turn, handed over the contraband to the petitioner herein, who in turn, packed them in 2 kgs packages and sold around 240 kgs of ganja. The ganja had been transported to Srilanka. The officials had conducted surprise raid in the residence of the petitioner and seized 260 kgs of ganja on 17.01.2021, which was intended to be transported to Srilanka. Hence, the case.

CRL OP(MD)No.8009 of 2023 3.The learned counsel appearing for the petitioner would submit that the petitioner is now suffering from so many illness and hence, he prayed for bail to the petitioner.

4.It is seen that this is second petition for bail and there is no change in circumstances. Hence, this Court is not inclined to grant bail to the petitioner. If at all the petitioner suffered from any illness, the authorities concerned are directed to give proper treatment to the petitioner. That apart, this Court already directed the trial Court to complete the trial process within one month. However, due to heavy work in the trial Court, the trial Court would not able to complete the trial as directed by this Court. The Trial Court is directed to complete the trial process as day-to-day basis within a period of one month from the date of receipt of a copy of this order. Accordingly, this criminal original petition is dismissed.
