ORDER
(By G.R.SWAMINATHAN, J.) This writ appeal is listed under the caption "for being mentioned" today ie., 15.12.2025.
2.This writ appeal was disposed of by us on 19.06.2025. The learned standing counsel for the appellant subsequently brought to our notice that our interpretation of Rule 54(6) of CCS Pension Rules, 1972 may not be correct. 3.In this writ appeal, the question arose whether pension can be paid to a mentally challenged son or daughter of a deceased pensioner. The authorities concede that pension has to be paid. But then, the claimant must produce an 2/4
income certificate noting the income from all sources. After referring to the case of one T.A.Sujatha, daughter of Shri.T.S.Arunachalam, Former Acting Chief Justice of the Madras High Court, we observed that such insistence may not be in order.
4.Now that we had noted the subsequent amendments also, we are of the view that the observations made in Paragraph No.3 to 7 of the order dated 19.06.2025, have to be recalled. They are accordingly recalled. 5.We place on record the fact that office of the Principal Accountant General (Accounts and Entitlements), Tamil Nadu had issued sanction order dated 12.12.2025 sanctioning payment of pension to Ms.T.A.Sujatha, daughter of Shri.T.S.Arunachalam, Former Acting Chief Justice of the Madras High Court.
