To Cancel the suspension of sentence/Bail granted in favour of the respondent herein in Crl.M.P(MD). No. 2103 of 2025, dated 08.12.2025 pending disposal of the main Criminal Appeal in Crl.A.(MD). No. 221 of 2025 arising out of the Sessions Case No.172 of 2022 on the file of the learned Mahalir Neethimandram (Fast Track Court), Thoothukudi District.

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed seeking for the cancellation of bail granted in favour of the respondent in Crl.M.P(MD).No.2103 of 2025, dated 08.12.2025.

2. Heard the learned counsel on either side.

3. The respondent was convicted and sentenced for the offences under Sections 302, 341, 376(A), 392 r/w 397 of IPC and was sentenced to undergo life imprisonment by the Mahalir Neethimandram (Fast Track Court), Thoothukudi in S.C.No.172 of 2022 by judgment dated 06.08.2024. The said judgment was challenged before this Court in Crl.A.

(MD).No.221 of 2025. A petition in Crl.M.P.(MD).No.2103 of 2025 was filed by the respondent seeking for suspension of sentence. This Court by an order dated 08.12.2025 was pleased to suspend the sentence by imposing certain conditions.

The present petition has been filed on the ground that the respondent was once again involved in the commission of another offence under the POCSO Act and an FIR was registered in Crime No.118 of 2026 on 11.03.2026. In the course of investigation, it came to light that the respondent has committed offences under Sections 5(l) and 6 of the POCSO Act and under Sections 103(1) and 104 of BNS. The respondent was arrested and remanded to judicial custody in this case.

The learned Additional Public Prosecutor appearing for the State / petitioner submitted that the respondent has misused the liberty that was granted by this Court by committing a heinous crime and that already the investigation has been completed in this case and the Police is in the process of filing a final report.

6. In our considered view, taking note of the subsequent crime that has been allegedly committed by the respondent and the nature of offence involved, we are inclined to withdraw the earlier order passed in Crl.M.P. (MD).No.2103 of 2025 dated 08.12.2025 and cancel the bail granted to the respondent.
