For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 456 of 2020 on the file of the Respondent Police.

ORDER : The Court made the following order :- This is the petitioner's second anticipatory bail application. The petitioner/sole accused apprehending arrest at the hands of the respondent police for the offence punishable under Sections 21(1) of Mines and Minerals (Development and Regulation) Act r/w 379 of IPC in Crime No.456 of 2020, on the file of the respondent police, seeks anticipatory bail.

2.The petitioner's earlier anticipatory bail application was dismissed on 31.08.2020 in Crl.O.P.(MD)No.9133 of 2020, on the ground that the petitioner is already having 36 previous cases which are similar in nature and he is a habitual offender. Now the second anticipatory bail application has been filed by the petitioner. https://hcservices.ecourts.gov.in/hcservices/

3.The learned counsel appearing for the petitioner submitted that the petitioner is not having any previous case and all the cases are falsely foisted against him. None of the cases, the petitioner is involved in the offence. The respondent police, deliberately and with malafide intention, has registered 34 cases against the petitioner. In some of the cases, the petitioner also acquitted. He would further submit that the petitioner is very innocent person and law abiding citizen and whatever conditions imposed by this Court, he will abide it.

4.The learned Government Advocate (Crl. Side) appearing for the State filed a status report giving particulars of the cases pending against the petitioner.

5.From the perusal of the report, it is seen that as many as 36 cases are pending against the petitioner. Some of the cases are registered under under Section 302 of IPC and nearly 10 cases are registered under Section 380 of IPC and five cases are registered under the Mines and Minerals (Development and Regulation) Act. 6.Considering the above facts and circumstances of the case, I find no ground to grant anticipatory bail to the petitioner. Hence, this petition stands dismissed.
