O R D E R

The present petition has been filed by the accused No.1 to 3 in S.T.C.No.02/2026, on the file of Judicial Magistrate Court, Valliyoor, Tirunelveli District seeking to quash the charge sheet, wherein, the Petitioners have been charge sheeted for the offence under Section 160 of IPC.

2.A perusal of the charge sheet reveals that out of six accused persons, three of them have formed a group and they have picked up quarrels with the other three accused persons and they have pushed each other on 22.3.2024 at 9.00 p.m. near a temple.This has cused disturbance to the general public as well as to the public transport.

3.According to the learned counsel for the Petitioners, there is no allegation of disturbance to the general public and it was not 2/5

taken in a public place and there was no fight between these accused persons.

4.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 5.As could be seen from the FIR that on 22.3.2024, at about 9.00p.m., in a remote village, six of the accused persons said to have entered into some kind of scuffle among themselves. There is no specific allegations against them causing disturbance to the general public or transport and the witnesses to the occurrence are the Police officials. Considering the above said facts, the continuation of criminal proceedings is only an abuse of process of law 6.In view of the above facts, the charge sheet in S.T.C.No. 02/2026, on the file of Judicial Magistrate Court, Valliyoor, Tirunelveli District stands quashed insofar as the Petitioners are concerned and the Criminal Original Petition stands allowed.
