Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the fourth respondent to release the Ashok Leyland Tipper Vehicle bearing registration No.TN 63 BC 7979 on the basis of the representation given by the petitioner in person on 31.08.2020.

ORDER

Heard the learned counsel on either side.

2. The petitioner seeks release of the petition mentioned vehicle.

3. The learned Additional Government Pleader appearing for the respondents points out that both the petitioner as well as the vehicle in question have been involved in the previous cases of the same in nature.

4. I am therefore not inclined to grant relief in this writ petition. But the respondent police cannot keep the vehicle in his custody and the fourth respondent must produce the vehicle in question before the jurisdictional Court without any delay. The petitioner is at liberty to move the jurisdictional Court to get appropriate relief.

5. With the above observation, this Writ Petition is dismissed. No costs.
