C-60. To suspend the sentence imposed against the petitioner by the judgment in Special S.C.No.83 of 2019 dated 02.09.2022 on the file of the Special Court for Exclusive Trial of Cases under POCSO Act, Thoothukudi pending disposal of the Criminal Appeal.

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed to suspend the sentence imposed on the petitioner by the judgment in Special S.C.No.83 of 2019, dated 02.09.2022, on the file of the Special Court for Exclusive Trial of Cases under the POCSO Act, Thoothukudi, pending disposal of the Criminal Appeal.

2. When the Court was not inclined to grant suspension of the sentence imposed on the petitioner, the learned counsel for the petitioner sought permission of this Court to withdraw this petition and made an endorsement to that effect.

3. In view of the above, this Criminal Miscellaneous Petition is dismissed as withdrawn.

4. Considering the fact that the accused person has been in jail from the year 2019 onwards, there shall be a direction to the Registry to prepare the paper book forthwith and add this case under the caption "Final Hearing Cases".
