ORDER

This Criminal Original Petition is filed to direct the first respondent to transfer the investigation in Cr.No.35 of 2024 on the file of the third respondent to any other competent office under the supervision of the first respondent and to complete the investigation.

Learned counsel for the petitioner submitted that due to previous enmity, on 03.02.2024, the accused persons have abused the petitioner, assaulted him with deadly weapons like knife and criminally intimidated him. The petitioner was admitted in Government Hospital, Theni and a case in Crime No.35 of 2024 was registered by the third respondent for the offences under Sections 147, 294(b), 323, 324, 506(2) of IPC and Section 4 of Tamil nadu Prohibition of Harassment of Women Act, 2002. The contention of the petitioner is that since the accused persons have attempted to murder the petitioner, the Section 326 and 307 of IPC would have been made out. Therefore, seeking transfer of investigation from the third respondent police to any other competent authority, this petition came to be filed.

3. The learned Government Advocate, on instructions, would submit that the investigation has been completed and a final report has also been filed before the Additional Mahila Court, Theni, in C.C.No.234 of 2025. Hence, nothing survives for further adjudication.

4. In view of the fact that final report has been filed, this Criminal Original Petition is closed. However, taking into consideration the fact that the petitioner was stabbed by the accused persons with knife and the petitioner is at liberty to challenge the final report, by filing a petition seeking further investigation under Section 173(8) Cr.P.C., / 193 (9) BNSS, 2023, if not satisfied by the manner in which final report is filed. 02.02.2026 NCC : yes / no Index : yes / no Internet : yes /no pnn 3/4
