ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the Judicial Magistrate Court No.II, Kuzhithurai, Kanyakumari District, to conduct the trial of the case in C.C.No.325 of 2020, expeditiously within a stipulated time

2. When the matter was called on 25.04.2023, a report has been called for from the Judicial Magistrate Court No.II, Kuzhithurai, Kanyakumari District, as to the stage of the trial process. When the matter is called today (ie.22.06.2023), a Report from the Judicial Magistrate Court No.II, Kuzhithurai, Kanyakumari District, has been received and it has been stated that against the first accused warrant was issued and so far it has not been executed. Because of the pendency of the warrant, the trial Court could not be commenced and completed.

3. Considering the offence involved in this case, there shall be a direction to the respondent police to execute the warrant against the first accused, within a period of one month from the date of receipt of 2/4

copy of this order. After execution of the warrant, let the trial be completed within a period of five months.

4. With the above directions, this Petition is disposed of. 22.06.2023 NCC :
