ORDER

This Criminal Original Petition has been filed to direct the respondents 1 to 5 not to harass the petitioner and consequently directing them not to interfere with the civil dispute arising out of dwelling house in the guise of enquiry.

2. On the side of the petitioner, it is stated that the respondent police are harassing the petitioner in the guise of an enquiry and prayed for an order of not to harass the petitioner and not to interfere in the civil dispute.

3. On the side of the prosecution, it is stated that already the petitioner has filed a case against the sixth respondent which is pending in C.S.R.No.38 of 2022. The dispute is with regard to ownership of a building.

4. When the petitioner has filed a petition for similar remedy before the respondent police, the petitioner cannot now claim that the police should not interfere in a civil dispute. So the petitioner is directed to appear before the respondent police and to co-operate for the enquiry and the respondent police is directed not to physically harass the petitioner in the guise of an enquiry and to conduct a proper enquiry and decide the issue as per law.

5. With the above direction, this Criminal Original Petition is disposed of.
