Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.ISAAC MOHANLAL Senior Counsel for M/S.K.M. THIRUPATHI, Advocate for the petitioner and of Mr.OHM CHARIMA PRABHU Additional Public Prosecutor for R2 and Mr.S.M.A.JINNAH Advocate for R1 for the Respondents the court made the following order:- Heard the learned senior counsel appearing for the petitioner/defacto complainant and the learned counsel appearing for the accused as well as the learned Government Advocate (Criminal side).
2. This Court had granted bail to the accused herein, in view of the filing of the final report by the police. To cancel the said order, this miscellaneous petition has been taken out by the defacto complainant.
3. This Court firmly told the learned counsel appearing for the accused that the accused will have to abide by law and that any breach of undertaking given before this Court would lead to serious consequences. Thereupon, the learned counsel appearing for the https://hcservices.ecourts.gov.in/hcservices/
accused on instructions from the accused undertook that he will take recourse to civil remedies and that unless he gets any decree in his favour from the competent Court, he would not interfere with the rights of the defacto complainant insofar as the Survey Nos.45/15-A and 15-B are concerned.
4. Recording the said undertaking, this Criminal Miscellaneous Petition is closed.
