The petitioner is the sole accused in Special SC No.80 of 2022, on the file of the learned Sessions Judge, Fast Track Mahila Court, Ramanathapuram. He was found guilty by the trial Court for the offence under Section 7 r/w 8 of POCSO Act, convicted and sentenced to undergo 3 years rigorous imprisonment with fine of 1/3

Rs.500/-, in default, he has to undergo simple imprisonment for one month. As against the conviction and sentence imposed by the trial Court, the petitioner has filed a Criminal Appeal in Crl.A(MD) No.553 of 2024. The petitioner has also moved this application to suspend the sentence imposed on him by the trial Court. 2.The learned counsel appearing for the petitioner submits due to family dispute, a false case has been registered as against this petitioner. 3.The learned Government Advocate appearing for the respondent submits that there are enough materials available on record as against this petitioner, as per the evidence adduced by the prosecution and there is no infirmity in the prosecution case and therefore, he prays for dismissal of this petition. 4.Considering the facts and circumstances of this case, this Court is not inclined to suspend the sentence imposed as against the petitioner. Accordingly, this criminal Miscellaneous Petition is dismissed.
