PRAYER: Civil Revision Petition is filed, under Article 227 of the Constitution of India, to direct the learned District Judge, Kanyakumari District at Nagercoil to dispose the O.S.No.63 of 2008 within the stipulated period of time.

ORDER

This Civil Revision Petition is filed to direct the learned District Judge, Kanyakumari District at Nagercoil to dispose the O.S.No.63 of 2008 within the stipulated period of time.

2. The revision petitioner filed O.S.No.63 of 2008 on the file of the learned District Judge, Kanyakumari District at Nagercoil, for the relief of specific performance of the agreement of sale deed dated 17.02.2007.

3. The learned counsel appearing for the petitioner submitted after commencement of trial the evidence was closed on 22.08.2013 and thereafter, the suit was posted for arguments on 27.08.2013 and from that date onwards, the said suit is being adjourned without any progress.

4. I have heard the learned counsel appearing on either side and perused the materials available on record. https://hcservices.ecourts.gov.in/hcservices/

Having been taken into consideration of the material facts and circumstances, this Court is of the view that in the interest of justice, it may be expedient to issue a direction to the learned District Judge, Kanyakumari District at Nagercoil. Accordingly, this Civil Revision Petition is allowed and the learned District Judge, Kanyakumari District at Nagercoil is directed to dispose of O.S.No.63 of 2008 as expeditiously as possible, in any event, not later than 30th April 2017.
