Heard both sides.

2. The case on hand involves the affairs of the private school known as Thiru.Namperumal Middle School. The petitioner was working there as Craft Teacher. He wants to be nominated as a member of the school committee. Unless the petitioner is nominated by the concerned entity, the respondent cannot be expected to issue proceedings nominating the petitioner. In this writ petition, the department alone is figuring as the sole respondent. The educational agency has not been shown as party.

3. I wanted to know from the petitioner, if the petitioner is confident that Namperumal, the petitioner's brother who the Secretary of the educational agency will nominate the petitioner. The petitioner indicates that there is a dispute between the two. In these circumstances, the prospect of the petitioner to nominate him is rather bleak. The department cannot be blamed. It cannot be mandated to nominate the petitioner as a member of the school committee. The petitioner will have 2/4

3 W.P.(MD)NO.10606 OF 2024 to establish his case in the pending civil proceedings. Without doing so, filing the writ petition is misconceived. This writ petition stands dismissed. No costs.
